In strong, clearly written judgments handed down in full on Dec 11, (in summary on Nov 8), Chief Justice Denham and Justices Fennelly, O’Donnell, Murray and Hardiman, explained the nature of our sovereignty, its institutional basis in the Irish Constitution and the vital role played by constitutional referenda in the exercise of that sovereignty.

The judgment makes clear that our Government and specifically, Minister Fitzgerald, in spending €1.1m of public funds on a one-sided and misleading “information campaign”, had “clear disregard” for the rules of referenda and as such for us, the sovereign people of Ireland.
