A 61-year-old man was formally arrested on Thursday for the purpose of being charged with dangerous driving causing the death of an eight-year-old boy one year ago in Carrigaline.
Garda Dinah Birnbaum charged John Moynihan, of Parkanillane, Kilnamartyra, Macroom, Co Cork, with dangerous driving at Cork Road, Carrigaline, Co Cork, causing the death of eight-year-old André Ladeiro on August 12, 2023.
Sergeant GearĂłid Davis said at Cork District Court the Director of Public Prosecutions directed trial by indictment at Cork Circuit Criminal Court and also consented to a signed plea of guilty being entered by the defendant for sentencing at the circuit court.
Prosecution evidence is to be supplied to the defendant’s solicitor, Seán Cahill, so consideration can be given to the possibility of a signed plea of guilty, should that arise.
Judge Mary Dorgan adjourned the case until October 17 for that matter to be considered.
Mr Moynihan was remanded on bail until that date at Cork District Court.
No evidence was given in court on Thursday in relation to the circumstances that gave rise to the charge being brought.
