Judge Con O'Leary said it would have been better to have charged the man with criminal damage rather than burglary.

A 39-year-old man who kicked in the door of a house had the case against him dismissed today when the judge said it would have been better to have charged him with criminal damage rather than burglary.

The same defendant also contested a case where he was caught with a weapon which fitted into the fist with sharp points on either end.
