Independent TD John Halligan has said it is up to the courts to decide if proposed abortion legislation is unconstitutional.

The new laws, put forward by the Independent TD Mick Wallace, would allow terminations in the case of fatal foetal abnormalities.

The Taoiseach has said he was told by the Attorney General that the laws would be at odds with the Constitution.

A vote is due on the issue on Thursday, however the Cabinet will continue to discuss it today.

Halligan has said there is still no definite decision on the possible abortion laws.

“The Attorney General advice is advice and it is her opinion,” said Halligan.

“There may be very, many eminent barristers who may agree with that. My argument has always been that if there is something unconstitutional, let the courts decide on that.

“If this bill was to pass, which I don’t if it will pass, well then let it be challenged.”
