A Dublin man is appealing against his conviction for murdering his partner with an 'unmerciful' kick to the stomach.

A Dublin man is appealing against his conviction for murdering his partner with an 'unmerciful' kick to the stomach.

Derek Finlay was jailed for life for killing 38-year-old Noeleen Brennan at his home on Knockmore Green, Killinarden, Tallaght in November 2008.

His lawyers say there was an element of bad luck to the case as a single kick to the stomach doesn't normally result in death.

They say the jury at the trial didn't get enough guidance on what should satisfy them that the accused intended to kill or cause serious harm.
