A Dublin man convicted of murdering a security guard during an armed raid at Clerys department store in 1982 is to make a High Court bid for freedom tomorrow.

Michael Gibbons of Oranmore Road, Ballyfermot, was released from prison on license 12 years ago but is back in Mountjoy for breaching its terms.

He failed to carry out a community service order following a District Court conviction for "threatening, abusive and insulting behaviour".

The 63-year-old's lawyers are challenging his detention on grounds that his license for release was revoked without any hearing.

Lawyers for the Governor of Mountjoy say significant concerns have been raised by the probation service they want time to carry out a psychiatric evaluation.
