A man who sued a midwife for interrupting his filming of the birth of his child is to be allowed continue with a defamation action against The Sunday Times, after the High Court agreed to strike out some of his claims.

A man who sued a midwife for interrupting his filming of the birth of his child is to be allowed continue with a defamation action against The Sunday Times, after the High Court agreed to strike out some of his claims.

John McAuley, of Beattie Park, Celbridge, Co Kildare claims an article about the original proceedings, by journalist Brenda Power, made him look like "an idiot".

Lawyers for the paper, and Brenda Power, tried to stop his latest legal action arguing the article was not defamatory, and that Mr McAuley has no chance of success.

However, High Court President Nicholas Kearns today gave his permission for the bulk of the case to go before a jury.
