A Waterford Garda has today been found not guilty of assault causing harm, but guilty of assault on a civilian in the city last year.

The jury of five men and seven women took over four hours to find Sergeant Martha McEnery not guilty of assault causing harm on Anthony Holness at New Street in Waterford on January 29, 2010.

However, the jury did convict Sergeant McEnery of the lesser charge of assault.

She has been remanded on continuing bail for sentence on November 7 next.

Garda Daniel Hickey was last Friday convicted of assault causing harm to Mr Holness, while another Garda, Alan Kissane, was acquitted of the same charge.

A fourth garda was convicted of perverting the course of justice when a jury found he deliberately switched a CCTV camera away from the arrest.
