The High Court has approved an award of €2.35m in damages to the family of a woman who died shortly after giving birth at a Dublin maternity hospital.

The High Court has approved an award of €2.35m in damages to the family of a woman who died shortly after giving birth at a Dublin maternity hospital.

Mrs Taz (Tazeem) Kenefick, a 35-year-old dentist, died following complications that occurred during and shortly after she gave birth to her second child at the National Maternity Hospital, Holles Street, Dublin on November 28, 2004.

Arising out of the circumstances of her death her husband Kevin Kenefick, also a dental surgeon, of Putland Road, Bray, Co Wicklow brought proceedings for alleged negligence and breach of duty against both the National Maternity Hospital and a consultant obstetrician at the hospital, Dr Stephen Carroll.

Today, following discussions between the parties, Mr Justice Iarfhlaith O'Neill was informed by Dermot Gleeson SC for Mr Kenefick that the issues been resolved.

Counsel told the court that the total of the award was €2.35m plus costs to the family of the late Mrs Kenefick. The judge said that he was "quite satisfied" to approve the award.

The award was against the hospital, who had admitted liability. The judge was informed that the action against Dr Carroll had been discontinued and was struck out. The case was before the court for assessment of damages only.

In the action Mr Kenefick (aged 55) claimed that as a result of his wife's death he suffered mental distress, personal injuries, including a psychiatric injury, and loss.

He was unable to get over the circumstances of his wife's death. It was further claimed that the couple's children were deprived of their mother's love and devotion.
