Detective Garda Camen Ryan told the court, that when charged, the accused said "they made a serious error".
Judge Mc Donnell granted O' Brien legal aid and remanded him in custody to appear back in court next week.
O' Byrne, originally from Drimnagh, was shot dead in Tallaght on the March 13, 2009.
His partner, who tried to take the gun off the killer, was shot in the leg during the attack.
The couple's young child was sitting in the car at the time.
It is understood Byrne had links to one of the gangs involved in the Crumlin Drimnagh gangland feud.
