A middle-aged man was given a three-year jail sentence today for defiling a teenager by having sexual intercourse with her and keeping pornographic images of her on his mobile phone.
The offences originally came to light when a friend of the accused, John Carroll (aged 50), of Glashykinleen, Kiskeam, Mallow, Co Cork, went to change the ringtone of Carroll’s phone and inadvertently found the images showing intimate images of the teenager’s body.
Garda Padraig Reddington who investigated the case was asked for his view on Carroll’s attitude to the offences.
"He didn’t see a whole lot of difficulty with it, he didn’t see this as particularly wrong," the garda said.
At Cork Circuit Criminal Court in June Carroll pleaded guilty to the charge of defilement by sexual intercourse of a girl under the age of 17 on June 15, 2006 and a second charge of possessing child pornography on his mobile phone on February 12, 2007.
Judge Moran said of Carroll: "He said to the injured party that if she did not do what he wanted her to do he would leave the mobile phone around the place (for people to see)."
To that extent the injured part was in fear of Carroll, the judge added.
Tim O’Leary senior counsel said that the defendant had accepted responsibility for his actions although his level of insight was limited. Mr O’Leary said Carroll had suffered extensively already for what he had done as his life as it had been in a rural community was effectively over.
Judge Patrick J. Moran agreed to delay the commencement of the sentence until November 20 to allow him time to put matters in order in relation to the care of animals on his farm.
