Mr Curtin resigned from his position earlier this week on the grounds of poor health.

The move ended the Oireachtas investigation set up to decide if he should be removed from the bench following his acquittal on child pornography charges.

Reports this morning say the ex-judge will have to submit medical evidence to the Department of Justice if he plans to claim his €19,000-a-year pension.

A Government spokesman has reportedly said he will not receive a pension unless he can prove his incapacity.
