A murder trial collapsed today at the Central Criminal Court following legal argument.

Mr Thomas Murphy (aged 25), of Wellview Avenue, Mulhuddart, Dublin 15, had pleaded not guilty to the murder of Mr Jason Tolan (aged 24), of Swords, Co Dublin, in an area known as the "shanty field", Church Road, Mulhuddart, Dublin 15, on November 11, 2003.

Today at the Central Criminal Court, the trial began hearing its first day of evidence. But after an application was made to the trial judge, Ms Justice Elizabeth Dunne, the jury was discharged.

"As a result of an application made to me, I feel I have no option but to discharge you of your duties," Ms Justice Dunne told the jury of six women and five men.

Addressing the jury, Judge Dunne said: "It’s just one of those things that happens".

Ms Justice Dunne told the jury that a new date for trial would be set.
