High Court to begin hearing McDowell planning dispute

The High Court is due to begin hearing Minister for Justice Michael McDowell's legal action against Roscommon County Council today.

Mr McDowell and his wife are challenging the council's refusal to extend planning permission for his holiday home in Roosky when it expired earlier this year.

The council refused to extend the permission because, it said, the house that was partially-built on the site differed substantially from that outlined in the original plans.

The Minister and his wife were granted leave to seek a judicial review of the decision last October.

They want the High Court to declare that the council's actions breached the Planning and Development Act.
