The High Court has ruled that a Cavan woman can sue County Louth consultant obstetrician Dr Michael Neary for damages.

The High Court has ruled that a Cavan woman can sue County Louth consultant obstetrician Dr Michael Neary for damages.

Mrs Rosemary Cunningham of Kingscourt claims the doctor needlessly removed her left ovary.

Dr Neary and Our Lady of Lourdes Hospital in Drogheda, where he was previously employed, had applied to have the proceedings struck out, on the grounds they were statute barred, or brought outside the three-year time limit.

The decision in favour of Mrs Cunningham is expected to have a knock on effect for other cases that have been initiated against Dr Neary.
