Jury to retire in garda capital murder case

Final submissions are being heard in the case of a Dublin man charged with the capital murder of a garda sergeant two years ago.

Daniel O'Toole of Cashel Ave, Crumlin, denies the murder of Sgt Andrew Callanan, but admits manslaughter.

State counsel Peter Charlton said it was the prosecution case that Mr O'Toole walked into Tallaght Garda Station on July 21, 1999, and set it alight, causing the death of Sgt Callanan.

Defence counsel George Bermingham SC said the accused had intended to kill himself on the night in question and not anyone else.

He described Mr O'Toole's actions as "a botched suicide".

Mr Justice Paul Carney is due to charge the jury before they retire to consider a verdict, which is not expected before tomorrow.
