Man who ‘went AWOL’ gets 15 months for two assaults

Oisin Fahy, aged 25, with an address at 98 Street in Skibbereen, Co Cork, got prison sentences totalling 15 months, having been convicted for an assault during a fracas, a later charge of fracturing another man’s nose with a headbutt, and then resisting arrest when he was spotted outside a pub in his home town just last month.

Fahy appeared before Clonakilty District Court having been in custody since his arrest on May 22.

The court heard two gardaí on patrol in Skibbereen on May 22 had spotted Fahy outside the Fairfield Bar and recognising that there were outstanding bench warrants relating to him, sought to arrest him, but some of the other patrons began to voice objections.

Insp Ronan Kennelly, prosecuting, said Fahy tried to “break free” and twisted the wrist of one of the gardaí before he was handcuffed at which point “the game was up”.

The court heard the first assault involving Fahy took place in December 2013 in what was described as a fracas on leaving a nightclub.

The court was told that Fahy had a strong work ethic and employment record and that had he appeared at an earlier date regarding the December 2013 assault, the court would have been minded to give him a suspended sentence. However, at the court date last December, he failed to appear.

The court heard that in January last year, it was alleged he had assaulted a man in a pub in Skibbereen, when what started as a verbal altercation in a dispute over €200 ended with a headbutt that broke the victim’s nose. Fahy pleaded guilty to the charge.

The court also heard that in June 2014, he had caused €355.59 worth of damage to the car of his ex-partner.
