A 68-year-old man who took exception to his ex-partner starting a new relationship with a Kerryman harassed her by phone.

The court heard yesterday that he could not be dealt with by restorative justice, and the judge wanted to know why. A report, prepared for Cork District Court, concluded that Tom Murray, of 10A Wellington Road, Cork, was not suitable for the programme.

Judge Con O’Leary said he would have considered it an appropriate case for restorative justice. The judge put the matter back until June 9, for a representative of the restorative-justice programme to come to court to explain the decision. “I want the restorative-justice programme to assist me in understanding why the scheme cannot be adapted to such circumstances,” Judge O’Leary said.

Michael Joyce, defence barrister, said he was concerned about the well-being of the defendant, who was outside the courtroom during the brief hearing and who was in what Mr Joyce described as a very agitated condition. Judge O’Leary excused Murray’s attendance at Cork District Court, on June 9.

Evidence was given, previously, of the threats he had made, in voicemails, about his ex and her new partner: “I will fucking give it to you and that Kerryman. How can you do that to me, after all our time together?

“You got me locked up. I will fucking kill him. I hope you are proud of yourself, going out with a Kerryman. I will fucking kill him.” Sergeant Alan McCarthy said similar threats were made in other voicemails.

Judge O’Leary previously said the accused had no grasp of the wrong he had done, which included death threats to the 65-year-old neighbour with whom he had been in a relationship and which had ended ten years previously.

The judge said of Murray: “He is out of touch with reality. He has no concept of the offences he committed.”

Sergeant McCarthy said Murray committed 19 counts of harassment, which related to various dates from September to December, 2015.

Murray also assaulted the woman and her partner, assaulted Garda Agnieszka Pizlo, and engaged in four counts of threatening behaviour.
