At the High Court sitting in Cork, Mr Justice Michael Hanna approved the settlement offer in the civil action taken against Cork County Council and Co-Action West Cork Ltd of Bantry, Co Cork.
Maeve Collins, aged 28, had brought the action through her father Tom Collins of Oak Lodge, Cashelmore, Enniskeane, Co Cork.
John O’Mahony, for the plaintiff, said yesterday the accident occurred on July 25, 2008. It happened while crossing at a junction of three streets in Skibbereen, namely Main St, Townsend St, and Bridge St.
“It was at the time in effect a crater in the centre of the road,” he said.
The judge said the size of the hazard would have raised an issue of contributory negligence had the case gone to a full hearing.
Mr O’Mahony said that the defence may have asserted contributory negligence but counsel believed the plaintiff’s case would have succeeded with a possible allowance for contributory negligence in the order of 15% to 25%.
Approving the settlement offer the judge said he was delighted for the plaintiff and said it would cater for her needs into the future.
