Leonard Watters, aged 28, went to a man’s Dublin home for a “social visit” before stealing his wallet and using his ATM card to take €590, a judge heard yesterday.
Mr Watters, with an address at Woodview, Navan, Co Meath, was remanded on bail after he appeared at Dublin District Court charged with three counts of theft.
He is accused of stealing a named man’s wallet, containing €60 and bank cards, from his apartment in Kilmainham in Dublin on November 28 last. He also faces two counts of stealing €290 and €300 from bank machines at O’Connell St and Temple Bar Square on the same date.
Dressed in a navy suit, blue shirt, and brown shoes, he spoke briefly during the proceedings to greet the judge and to confirm his next hearing date suited him. No plea was entered.
Garda Graham O’Neill told Judge Cormac Dunne that Mr Watters was arrested by appointment on June 22 at Kilmainham Garda Station. He was charged with the three offences and “made no reply to charge after caution”.
Garda O’Neill told Judge Dunne that the DPP has directed “summary disposal”; this means the case could be dealt with at district court level and should not be sent to the circuit court, which has tougher sentencing powers.
Outlining the allegations, Garda O’Neill said the injured party’s wallet, which contained bank cards, was stolen. “The accused is alleged to have taken it from his apartment during a social visit,” he added.
Judge Dunne accepted jurisdiction meaning the case will be dealt in the district court.
Garda O’Neill told Judge Dunne that he has taken statements and he will be able to furnish copies of them to defence solicitor Leonard Leader very shortly.
Mr Leader informed the judge that he understood there was CCTV evidence.
Judge Dunne directed disclosure of evidence including the statements and video footage to the defence ahead of the next hearing. There was no objection to bail and the judge remanded Mr Watters to appear again in October when he will be expected to enter a plea.
Legal aid was granted after the court heard he is in receipt of disability allowance.
