Three members of a family who sued another member arising out of a collision “in a minor manner with a wall, “ succeeded in their claims at the Circuit Civil Court in Tralee yesterday and were awarded general damages decrees totalling €9,500 for minor injuries

Judge Gerald Keyes found negligence on the part of the driver and defendant (who was not in court) had been established.

Emmett O’Brien, counsel for the defendant, put it to one of the plaintiffs that the driver and defendant Thomas O’Brien, of Ashgrove Listowel, had taken insurance out on the 1996 Toyota Corolla just days before the accident.
