Dublin Airport Authority appeals charges ruling
DAA Plc has initiated judicial review proceedings against the Commissioner for Aviation Regulation over the treatment of the authority’s investment in the Dublin Airport City project in the regulator’s October 2014 Final Determination setting the maximum level of airport charges for 2015 to 2019.
Mr Justice Brian McGovern yesterday agreed to transfer the proceedings to the Commercial Court.
The DAC project involves the development of lands on the Dublin Airport campus.
It is claimed that, since 2009, the DAA has invested €44.9m in the DAC project. That investment was undertaken on a commercial basis with the expectation the lands and assets in question would be removed from the till at the final determination in 2014, the authority says.
