High Court judge Ms Justice Mary Finlay Geoghegan, warned yesterday they had two weeks to provide the statement or else they will have to appear personally in court to explain why on June 27.

The judge said she wanted to make it clear if they fail to comply, an order seeking to attach and commit them to prison for failure to do so still stands.

Last March, the Gilson Motor Co, Annaly Drive, Onger Wood, Dublin, was wound up by the High Court after it failed to pay €141,937 in taxes. Ms Gilson and her brother are listed as directors of the car sales company. They did not contest the order.

The court appointed Gary Lennon of Lennon Corporate Recovery as liquidator.

The court also ordered that both must file a statement of affairs within 21 days. The matter came before the High Court’s Examiner’s Court yesterday.

Yesterday, counsel for the liquidator told the Examiner’s Court there had been a failure to file that statement of affairs.

Counsel for the Gilsons sought a two-week adjournment, saying there had been a “parting of ways” between the directors and their former accountant.

Ms Justice Finlay Geoghegan said it was extremely serious that the directors were not complying with their obligations and there will come a time when the court would have to attach and commit them to prison unless they do so.

If the statement of affairs was not provided, the directors would have to appear personally before the court on June 27 to explain why, the judge said.

She would also have to deal with the question of costs on that day and that the directors should be aware of the “full consequences” of that, she said.
