Court rejects stall trader’s application

HAVING heard evidence of a possible fire hazard, the High Court yesterday turned down an application from a Henry Street stall trader for an injunction aimed at preventing Dublin City Council from stopping a number of stall holders from using petrol generators to light up their Christmas material in Henry Street, Dublin.

Evidence was given by Dublin city fire officer Ann Fegan that in recent years there were concerns about the use of petrol/diesel generators being used by stall holders in Henry Street.

Mr Justice Michael Peart, turning down the interlocutory injunction application, said it was unfortunate the matter should come before the court so soon before Christmas. He expressed the hope that for the future some sensible arrangement might be put in place.
