What the jury was not allowed to hear
In one of a number of pieces of evidence deemed inadmissible by Mr Justice Barry White, Limerick woman Barbara Hackett told gardaí that Joe spoke to her in 2003 about how he wanted out of his marriage and how he would accept nothing less than full custody of his children.
Mr Justice White agreed with the defence’s objection to Ms Hackett being called as a witness, ruling that remarks made by the accused in 2003 would not prove his state of mind a year later.
