Rossiters to take case against State

THE family of a 14-year-old who died in suspicious circumstances while in garda custody have served High Court writs on the Justice Minister and Garda Commissioner for his wrongful killing.

Yesterday, following adjournment of the inquest into the death of Brian Rossiter, solicitor for the Rossiter family, Cian O’Carroll, said proceedings had been served against the State, Minister Michael McDowell and Garda Commissioner Noel Conroy.

Brian was found in a coma in a garda cell on September 11, 2002, the morning after his arrest and detention at Clonmel Garda Station. He died in hospital two days later. His family later learned that Brian had told a friend, arrested on the same night, that he was assaulted by gardaí while in custody.
