RTE and businessman Declan Ganley have each alleged failure by the other to make proper discovery of documents for the businessman’s action claiming he was defamed in a Prime Time broadcast ten year ago.

A High Court judge has made orders joining businessman Declan Ganley to Denis O’Brien’s action alleging defamation and conspiracy against Red Flag Consulting.

Businessman Declan Ganley, who denies he is the client behind the commissioning of an allegedly defamatory dossier on Denis O'Brien, says he cannot be brought into the O'Brien case against a PR firm because the application is out of time.

Denis O’Brien's bid to have Galway-based businessman Declan Ganley joined as a co-defendant in Mr O’Brien’s case against Red Flag Consulting will be heard in March.
