LEGISLATION is being prepared which will enable registration of rights of way without a court order.

Rights of way without court order

The Land and Conveyancing Law Reform Act 2009 provided that easements such as rights of way shall be acquired at law only on registration of a court order. However, Justice Minister Alan Shatter said he intends to include necessary amendments in this year’s Civil Law Bill, to give statutory effect to a proposed draft scheme for simplifying the procedures for registering easements.
