Fatal assault suspect was arrested for later incident

A man believed to have carried out an attack outside a nightclub which led to the death of another man was arrested under the Public Order Act before emerging as the chief suspect for the assault.

James Tynan, 25, passed away on Monday at South Tipperary General Hospital in Clonmel, Co Tipperary, following the assault in Thurles.

He was socialising in the club at Hayes’s Hotel in the town’s Liberty Square on Saturday and left at about 1.30am on Sunday.It is understood that another man, unknown to James, ran down the street and punched him once in the face. James fell and hit his head and this proved to be the fatal injury.

The suspected assailant, who is from Co Tipperary and aged 22, was arrested later on suspicion of a separate breach of public order but, following further inquiries by gardaí, was re-arrested at 9am on Sunday for questioning regarding assault causing harm.

The suspect was released without charge on Monday night and a file is being prepared for the DPP.
