Wine licence granted despite Garda fears over public order problems

People drinking in bushes and public order problems were cited among reasons for Garda objections to a new wine retail licence in the Douglas area of Cork.

Sergeant Miriam McGuire said there was no problem with the character of the applicant at Cork District Court yesterday.

John O’Leary, director of Kevin O’Leary, Cork, applied for a wine retail licence for Centra at the newly re-opened Texaco at South Douglas Rd.

The objection was based on the link between off-licence alcohol and public order problems and the fact there were 13 premises in the area licensed for the sale of wine or all kinds alcohol.

Judge Olann Kelleher granted the licence, noting from the evidence the gardaí accepted the proposition that public order issues tended not to be associated with the consumption of wine.

However, he remarked: “I don’t know where we are going with all the licences.”

When asked by the judge if he felt there should be a laissez faire attitude to the granting of licences, Mr O’Leary said: “I don’t feel there should be a limit on the number of licences once the retailers are acting responsibly.”

Judge Kelleher asked Sgt McGuire why there was an objection to the licence. Insp Deasy said: “The State would say there is adequate facilities in the area for the provision of alcohol.”
