Injunctions against Facebook, Google
By Vivion Kilfeather - Wednesday, January 18, 2012THE High Court has continued for another week injunctions against several internet giants, including Facebook and Google, prohibiting them from broadcasting an allegedly defamatory video clip relating to a Dublin City University (DCU) student.
Eoin McKeogh, aged 22, a student of international business and Japanese, obtained the injunctions arising out of the broadcast of the clip, accompanying text, and a Facebook profile alleging he was guilty of taxi fare evasion. He claims if it is allowed to continue it will blight his career.
The injunctions are against Facebook Ireland Ltd, Google Ireland Ltd, Google US, Youtube, Youtube LLC, and Yahoo Ltd. They are also against a website called CrowdGather Inc and a number of "John Doe" usernames which have been allegedly used to post the material.
The orders also direct the defendants to take down, disable and/or remove the allegedly defamatory material pending the hearing of a substantive action.
They further direct the internet companies to disclose the identity of the web users and take the necessary legal steps to protect his name and to prevent further publication of the material.
Yesterday in the High Court, Mr Justice Michael Peart continued the orders to allow progress between Mr McKeogh’s lawyers and the defendants in trying to resolve the matter.
Pauline Walley SC, for Mr McKeogh, said he was looking to have the material permanently removed from the internet as it would blight his career and the rest of his life if allowed to continue.
Rossa Fanning BL, for Facebook, said Mr McKeogh had availed of his client’s complaints procedure and the profile had been disabled. While it was his understanding that it had been permanently disabled, it was possible to create another within 60 seconds, counsel said.
