Senator Ivor Callely’s challenge against the Seanad Committee's findings on his expenses claims has come back before the High Court.

The presiding judge asked both sides for submissions on the impact of the recent Pearse Doherty decision where the court found there had been an unreasonable delay in holding a by-election.

Senator Callely’s lawyers said the Donegal case illustrates that the courts do have powers to review decisions of the Oireachtas, particularly where an individual's constitutional rights are affected.

Mr Justice Iarfhlaith O'Neill has reserved judgment.
